RESOLUTION TO EXTEND A ONE HUNDRED EIGHTY DAY (180) MORATORIUM ON THE BUILDING OF DATA CENTERS WITHIN
THE TOWNSHIP OF ARMADA
Resolution No. 2026-02
At the regular meeting of the Township Board of Armada Township, Macomb County, Michigan, held at the Township Hall at 23121 E. Main St., Armada Township, MI 48005, on 14th day of January, 2026, commencing at 7:00 p.m.
Present: Nikkel, Swiacki, Goetzinger, Job and Krotche
Absent: None
The following Resolution was offered by Swiacki and seconded by Nikkel.
WHEREAS, there appears to be recent growth in the building of “Data Centers”;
WHEREAS, the term “Data Center” refers to a facility that primarily contains electronic equipment used to process, store, secure and transmit digital information, which may be: (A) a free-standing structure; or (B) a facility within a larger structure and that uses environmental control equipment to maintain the proper conditions for the operation of electronic equipment.
WHEREAS, the Board wishes to have sufficient time to have the planning commission and itself and the Township’s residents to consider the best practice for the location and/or regulation, to the extent permitted, of said Data Centers; and
WHEREAS, staff and legal counsel also wish to review same without other possible legal challenges in the interim, thus making it necessary to adopt this moratorium;
NOW, THEREFORE BE IT RESOLVED, the moratorium is adopted as follows:
- Moratorium. A temporary moratorium is hereby imposed on commencement of building or the building any Data Centers within the Township of Armada for a period of one hundred eighty (180) days.
- Scope of Moratorium. During the moratorium period, no permit applications or site plans for the building of any data centers shall be accepted, processed, or approved by the Township of Armada and no building of a Data Center or planning for building a Data Center shall occur.
- Review, Potential Revisions, and Purpose. During the moratorium period, the Township Board, together with Township staff and legal counsel, shall review the Township’s existing regulations and requirements relating to data centers and consider potential revisions in order to better protect the public health, safety, and welfare of the Township.
- This moratorium shall expire upon one hundred eighty (180) days and/or adoption of a subsequent revision or extension by the Township Board.
Any and all resolutions in conflict herewith are repealed only to the extent necessary to give full force and effect to the foregoing provisions.
This Resolution is deemed severable. Should any provision, clause, word or sentence be deemed unenforceable, the remainder shall remain in full force and effect.
